Agreement to Terms

By accessing or using DiveCrewPro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

DiveCrewPro is a scheduling software service designed specifically for dive shops. The Service allows dive shop administrators to manage class schedules, assign instructors and divemasters, and coordinate multi-day dive classes across multiple locations.

Account Registration

To use the Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Subscription and Billing

Subscription Plans

We offer various subscription plans with different features and pricing. Subscription fees are billed in advance on a monthly or annual basis, as selected during registration.

Payment

You agree to pay all fees associated with your subscription. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.

Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Transmit any harmful code, viruses, or malicious software
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam or unsolicited communications
  • Impersonate any person or entity
  • Violate the rights of others, including intellectual property rights

Intellectual Property

The Service and its original content, features, and functionality are owned by DiveCrewPro and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any data you submit to the Service. By using the Service, you grant us a license to use, store, and process your data as necessary to provide the Service.

Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

Limitation of Liability

To the maximum extent permitted by law, DiveCrewPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Indemnification

You agree to indemnify and hold harmless DiveCrewPro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DiveCrewPro operates, without regard to its conflict of law provisions.
